Basics Red Flag compliance with article

On August 1, 2009, the FACTA Red Flag Rule comes into force. If you own average small businesses that have not even heard of the Red Flag Rule. It also might think that only applies to financial institutions. However, these new rules affect nearly all businesses. The rules can be costly to implement and come with strong teeth. Not a good combination for small businesses struggling to stay afloat.

So what is the Red Flag article? In short, requires businesses to develop and implement a program to identify theft potential identity through suspected activities. These patterns of suspicious activity are called "red flags." Every business must create a compliance program to identify and respond to red flags. Once developed, employees should be trained in the program.

The Red Flag Rule is enforced by the Commission Federal Trade Commission (FTC). However, as the law of privacy as other recent, there are subsidies for individuals to seek damages from the companies. In other words, trial lawyers are salivating to join class actions. After August 1, if an employee can not recognize a red flag identity theft and report the sanction could be a financially crippling lawsuit.

The rule applies to any business that provides or is connected to credit customers. Almost every business qualifies as:

Medical Practices – Because the payment is made through an insurance company has determined that the FTC doctors' offices must comply. The AMA has not been successful in getting relief from the norm on the grounds that the practices are already covered by HIPAA.

Retail – The only exception is if a store offers exclusively on credit cards and cash. If a store allows purchases through credit, internal or external, must comply. This is every one that issued the invoices.

Services – Telephone companies, mobile phones, power companies or any other person extending credit.

Car Dealers – This includes the sale boats, RVs, motorcycles and power sports.

Banks and Financial Institutions – Everything from local bank credit cards for mortgage brokers.

Schools – Any school, college or university that offers or accepts financial assistance.

There are numerous methods to get in line. At the upper end is bringing in a law firm to review all business practices and design a custom program. This is very expensive, but is the most comprehensive and is almost certain of compliance. At the lower end is an off-platform solution. They are fairly inexpensive, but may require a lot of customization and have no guarantee that your business will be in compliance.

Any solution you choose should have some elements basic. The FTC mandates these four parts:

1. Identity relevant red flags. – Identify the warning signs of theft identity that are specific to your business. Among the most common are suspect documents, changes of address, the warnings from credit agencies, and communications victims or law enforcement.
2. Detect red flags. – Establish procedures to allow the detection of red flags business practices of everyday life.
3. To prevent and mitigate identity theft. – Setting reasonable answers when signals are detected warning. This includes monitoring or closure of accounts, but not open an account or notify potential victims of a problem.
4. Update your program periodically. – Each program must be evaluated and updated for changes in business practices and identity theft trends.

Once which has created a compliance program must educate their employees. This means more than the delivery of a document, but actively working with them to protect all private information in your care. All training must be documented for compliance records.
